SECTION 1 - ONLINE STORE & AGE COMPLIANCE

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state, province, or country of residence, and that you have given us your consent to allow any of your minor dependents to use this site. You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction.

SECTION 2 - ABSOLUTE LIMITATION OF LIABILITY

To the maximum extent permitted by applicable international law, in no event shall bbest, our directors, officers, employees, affiliates, or supply chain partners (including fulfillment platforms) be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind.

This includes, without limitation, lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service. Because some countries, states, or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

SECTION 3 - TRANSFER OF RISK & SHIPPING DISCLAIMER

By completing a purchase, you acknowledge and agree that all items are shipped via third-party global logistics carriers. The risk of loss and title for all merchandise passes to you (the buyer) immediately upon our delivery of the parcel to the carrier.

We are not responsible or liable for delivery delays caused by postal bottlenecks, weather, strikes, global transport volatility, or packages marked "Delivered" by local postal carriers but not physically found by the buyer. It is the buyer's strict obligation to provide an accurate, secure, and complete delivery address at checkout.

SECTION 4 - CROSS-BORDER CUSTOMS, TAXES, AND IMPORT DUTIES

Items are dispatched internationally to your delivery destination. The buyer is designated as the importer of record and must comply with all laws and regulations of the destination country.

Our product prices and shipping rates do NOT include local import duties, tariffs, value-added taxes (VAT), goods and services taxes (GST), or customs clearance fees instituted by your country. All such cross-border clearance charges are the sole and exclusive financial responsibility of the buyer. bbest has no control over these charges and cannot predict what they may be.

SECTION 5 - REJECTION OF UNILATERAL CHARGEBACKS & DISPUTE FLOW

The buyer explicitly agrees to contact our customer support team at support@bbest.com.co  to seek a resolution prior to initiating any chargeback, payment dispute, or reversal request with their bank, credit card issuer, or payment processor (such as PayPal).

In the event of a breach of contract claim or item discrepancy, the buyer agrees to submit valid photographic or video evidence directly to our customer support channel within 14 days of delivery. Unilateral chargebacks opened without following this mandatory direct-dispute resolution mechanism will be aggressively contested using these Terms as signed electronic authorization of the transaction.

SECTION 6 - ACCURACY OF BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse, limit, or cancel any order you place with us at our sole discretion. This includes orders that appear, in our sole judgment, to be placed by dealers, resellers, distributors, or orders flagged by our automated payment processors as high-risk for fraud. You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store.

SECTION 7 - SEVERABILITY

In the event that any provision of these Terms of Service is determined to be unlawful, void, or unenforceable under the local consumer laws of a buyer's country, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service. Such determination shall not affect the validity and enforceability of any other remaining provisions.

SECTION 8 - GOVERNING LAW & JURISDICTION

These Terms of Service, and any separate agreements whereby we provide you Services, shall be governed by, interpreted, and construed exclusively in accordance with the laws of Malaysia, without regard to conflict of law principles. Any legal action, dispute, or proceeding arising out of or relating to these Terms must be brought exclusively in a court of competent jurisdiction located in Malaysia.
